Search Posey County Court Records

The official online starting point for Posey County court records is Indiana MyCase. The Indiana Judicial Branch describes MyCase as the place to find case information and some documents, and the Posey County Clerk's Office links public case records to the same free system. MyCase is statewide, so a Posey County search should be narrowed by court, case type, status, file date, or a precise case number when the name is common.

MyCase does not replace the Clerk of the Posey Circuit/Superior Courts. Some older documents are not online, some public files have no document link, and certified copies still come from the clerk. Posey County uses a unified clerk for both Circuit Court and Superior Court, so the same office can direct a user to the correct counter, court office, or copy process.

Posey County Court Records Fields

The official search tips explain that case-number hyphens and leading zeroes are not required, citation numbers may need to match Odyssey exactly, and wildcard searching works only at the trailing part of a name or number. Date of birth can narrow party searches, but it is not displayed in public case details.

Types of Posey County Court Records

Posey County court records are split across Circuit Court and Superior Court by local rules and subject matter. The Superior Court page lists domestic relations, guardianship, adoption, small claims, civil, local ordinance, and protective-order matters.

The local rules add detail. All criminal cases are assigned to Posey Circuit Court. CHINS, termination of parental rights, domestic relations, adoption, guardianship, small claims, eviction, civil collection, civil tort, local ordinance, estate, trust, name change, and protective-order petitions are routed to Superior Court unless another rule applies. Traffic violations and infractions are assigned to Circuit Court.

What Posey County Court Records Show

A public Posey County case view may show a case header, court, case type, filing date, status, parties, attorneys, hearings, chronological case summary, document links, and financial entries. The chronological case summary is the docket or event log. It can show filings, notices, continuances, orders, judgments, sentencing, payments, and other actions. Public document links vary by case and age.

Public Access for Posey County Court Records

Indiana court records have their own access rules. General agency records may fall under the Indiana Access to Public Records Act, IC 5-14-3, but court case files are governed more directly by the Indiana Rules on Access to Court Records. Restricted Posey County Court Records

Several Posey County record types are not open like ordinary civil cases. CHINS hearings are closed to the public under the Superior Court FAQ, with only parties and attorneys allowed in the courtroom. Juvenile delinquency, CHINS, termination of parental rights, and adoption records are controlled by Indiana juvenile and confidentiality rules. Mental-health and treatment information is also restricted in many court contexts.

Rule 6 lets a court exclude otherwise public records only in extraordinary circumstances with required findings and process.

Posey County Certified Copy Requests

Certified copies and non-online records should be requested from the Clerk of the Posey Circuit/Superior Courts. The clerk's page names Kay Kilgore as clerk, lists court filing and traffic functions, and identifies two public counter locations. A request should include the case number when known, party names, document title, approximate filing date, and whether plain or certified copies are needed.

Historical court records may require a different path. The Indiana State Archives holds the earliest Posey Circuit Court records, including writs, summonses, subpoenas, transcripts, declarations, depositions, affidavits, and verdicts from the 1815 to 1855 collection period. For modern cases, use MyCase and the clerk first.
